Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Gatherly Ltd ("Gatherly," "we," "us," or "our") governing your use of the Gatherly mobile app and related services.

- Dispute Resolution: Write to us first at the address above and we will try to resolve it directly. The European Commission's Online Dispute Resolution platform ceased operating in July 2025; EU consumers can instead contact their national consumer authority or their local European Consumer Centre, and UK consumers their local Trading Standards service.
1. Eligibility and Registration
By creating an account or using Gatherly, you represent and warrant that:
- You are at least 18 years of age.
- You have the legal capacity to form a binding contract under the laws of your jurisdiction.
- You will provide accurate, current, and complete information, including your date of birth, your location and the preferences your matches are built from.
- Your use of the service does not violate any applicable law or regulation.
2. The Matching Service
Gatherly groups people into dinner parties of five and books a restaurant table for them. You buy dinner credits, choose the dates you are free, and turn matching on; groups are then formed automatically. Section 4 of our Privacy Policy sets out which of your data that uses.
- No Guarantees: We do not guarantee that a match will be found within any specific timeframe, that a dinner will go ahead, or that any group will suit your personal expectations.
- How a dinner is settled: once a group forms, one dinner credit is taken from each member and we look for a restaurant. When we have booked one we send you the restaurant, the time and the name the table is under, along with the first names of the others coming.
- If we cannot book a table: if no restaurant has been confirmed by 48 hours before the dinner, the dinner is cancelled and every member's dinner credit is returned.
- Cancelling: you can cancel your place from the app. Cancelling does not return your dinner credit. If enough members cancel that the dinner cannot go ahead, it is cancelled and the remaining members get their credit back.
- Service Modifications: We reserve the right to modify technical parameters or discontinue parts of the service for maintenance, security, or product improvements.
3. Right of Withdrawal (EEA/UK Consumers)
If you reside in the EEA or UK, you have the right to withdraw from this contract within 14 days without giving a reason. Nothing in these Terms takes that right away from you.
- Exercise of Right: Contact us via an unequivocal statement at [email protected].
- Early Performance: By turning matching on before the end of the 14-day period, you expressly request that we begin immediately and you acknowledge that you lose the right of withdrawal in respect of a dinner credit once it has been spent on a group that has formed.
- Purchases through the stores: dinner credits are sold to you by Apple or Google, not by us. Where your statutory withdrawal or cancellation right applies to that purchase, you exercise it against the store you bought from, under its terms.
4. Dinner Credits, Payment and Refunds
Dinners are paid for with dinner credits, bought in the app as a one-off purchase. There is no subscription and nothing renews automatically.
- Who sells them: credits are sold through the Apple App Store or Google Play. That store, not Gatherly, is the seller of record and takes the payment. Prices are shown in the app before you buy and include any tax the store applies.
- What you get: the number of credits shown on the bundle you bought, added to your balance once the store confirms the payment. Credits do not expire and have no cash value. They cannot be transferred, sold or exchanged for money.
- What a credit buys: one seat at one dinner. A credit is spent at the moment a group forms around you, not when a restaurant is booked and not when you turn matching on.
- Refunds: purchases are final and Gatherly does not refund them. Refund requests are handled entirely by Apple or Google under their own policies, and only they can issue one. We have no ability to reverse a store charge.
- When we return a credit instead: if we cancel a dinner because no restaurant could be booked in time, or because too few members remain, the credit is returned to your balance so you can use it on another dinner. This is a credit back to your account, not a refund of money.
- When we do not: if you cancel your own place, or do not turn up, the credit is not returned.
- Your statutory rights: none of the above limits any right you have under mandatory consumer law in your country, including the withdrawal right in section 3.
5. User Conduct and Safety
- No Background Checks: Gatherly does not conduct criminal background checks or identity verification beyond basic service authentication.
- Offline Interactions: Gatherly facilitates introductions but does not organize the dinners or act as an agent for restaurants. You are solely responsible for your interactions. We strongly recommend meeting in public, staying with the group of five, and notifying a contact of your location.
- Prohibited Behavior: Harassment, stalking, failing to turn up to a dinner you are booked on, or providing false information to influence your matches is prohibited and may result in your account being suspended or terminated.
- Reporting: if something goes wrong at a dinner or a member behaves badly, email [email protected]. There is no in-app reporting tool; email is how you reach us. If you are in danger, contact your local emergency services first.
6. User Content and License
You remain the owner of the photos, text, and profile info you submit ("User Content").
- License Grant: You grant Gatherly a non-exclusive, royalty-free, worldwide license to host, store, and display your User Content strictly to operate and improve the service.
- Termination of License: This license ends when you delete your content or account, subject to technical backup cycles and existing match records.
7. Accounts and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately at [email protected] if you suspect a security breach.
8. Third-Party Services
Gatherly relies on third-party providers, including the app stores you buy through and the mapping and messaging services the app uses. Section 5 of our Privacy Policy lists the ones that receive your data.
- Your use of these features is subject to their respective terms.
- We are not responsible for the accuracy of third-party restaurant data, ratings, or availability.
9. Prohibited Conduct
You agree not to:
- Use the service for scams, spam, or unauthorized commercial solicitation.
- Attempt to scrape data, reverse engineer the app, or bypass security measures.
- Collect or publish another user's personal data without authorization.
10. Limitation of Liability
To the fullest extent permitted by law:
- EU/UK Standard: Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.
- General Limitation: Gatherly is not liable for user conduct at physical events or restaurant service quality. Our total aggregate liability for technical failures is limited to the amount paid (if any) or €100 / $100 USD.
- Indirect Damages: We are not liable for indirect, incidental, or consequential losses (e.g., loss of profits or data).
11. Termination
- By You: You may stop using the service and delete your account at any time.
- By Us: We may suspend or terminate access if we reasonably believe you have violated these Terms or our Community Guidelines, or that your account is being used fraudulently.
12. Intellectual Property
All software, matching logic, branding, and trademarks are the exclusive property of Gatherly. You are granted a limited, revocable, non-transferable license for personal, non-commercial use of the app.
13. Governing Law and Jurisdiction
- Governing Law: These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules.
- Consumer Rights: Mandatory consumer protection laws in your country of residence remain unaffected.
- Jurisdiction: You may bring legal proceedings in the courts of London, England or in the courts of your place of residence.
